FREE YAK SERVICE FOR ONE YEAR

The Free Yak Service for One Year contest is open to all Canadian residents excluding Quebec, who have reached the age of majority. Employees, members of their immediate families and persons domiciled with employees of Yak, their advertising and promotional agencies are not eligible. By entering this contest, participants agree to abide by the Official Contest Rules and Regulations and the decisions of Globalive Communications Corp. and Yak Communications (Canada) Corp., (the “Sponsor”) which are final.

CONTEST PERIOD

Contest runs from September 18, 2009 to December 31, 2009.

HOW TO ENTER

Only one (1) entry per account allowed. To be eligible, entries must be received during the contest period. The odds of winning depend on the number of eligible entries received during the contest period. Automatic ballot entry will be placed into the draw upon review of account status 90 days after sign up for Yak service. Customer account may not have a 30+ balance. Customer must have made at least 3 payments. Customer is on PAP. Offer not applicable to any other service on customer account and is non-transferrable and has no cash value. Offer open to new and existing customers.

All entries become the property of Sponsor. No responsibility is assumed by Sponsor for any lost, late, damaged, destroyed, misidentified, illegible or misdirected entries or for any other such problems occurring in connection with participation of this contest.

NO PURCHASE NECESSARY; Mail-in Option

Send your address and phone-number along with a self-addressed stamped envelope to: Free Yak Service for One Year, c/o Yak Communications (Canada) Corp., 48 Yonge Street, Toronto, Ontario, M5E 1G6. Each postmarked envelope received by Yak will count as one (1) entry. Only one (1) entry per person is allowed. To be eligible, entries must be received during the contest period noted above.

WHO CAN ENTER

Contest is open to Ontario residents over the age of majority except employees, representatives and agents of Globalive Communications Corp. and Yak Communications (Canada) Corp., (the “Sponsor”), its advertisers and promotion agencies and the persons with whom they are domiciled and member of their immediate family. Limit: One entry per person. Odds of winning depend on the number of eligible entries received. In order to win, the selected participant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a pre-arranged, mutually convenient time. The contest is not open to residents of Quebec.

Entrants must be (1) current customers with Yak Communications (Canada) Corp., adding Yak Home Phone Lite, Yak Home Phone Fully Loaded, Yak High Speed Internet or Yak Basic, Yak Lite or Yak Fully Loaded Paks or (2) new customers signing up for Yak Home Phone Fully Loaded, Yak High Speed or Yak Basic, Yak Lite or Yak Fully Loaded Paks provided they sign up with a credit card on pre-authorized payment. Yak Home Phone Lite sign ups are only eligible for One Year Free Service. All entries are entered after maintaining current account status after 90 days from sign up although eligibility is based on sign up date. Those ballots not selected for monthly prize will be added to subsequent month’s draw.

THE PRIZES

There will be three (3) prizes awarded consisting of free Yak service for 365 days from date of draw. Prize will be based on value of service signed up for at time of promotional offer and cannot be upgraded with change in customer portfolio. Costs of any additional services will be billed to customer for the term of free service.

THE FOLLOWING CONDITIONS APPLY:

The prizes must be accepted as awarded without substitution and is not transferrable or redeemable for cash or allowed to be sold. The Sponsor reserves the right to substitute the prize in whole or in part in the event that all or any of the components of the prize is unavailable. In the event that the winner is unable to redeem the prize due to reasons beyond the control of the Sponsor, their employees, representatives, agents and all parties associated with this Contest, no compensation or substitution prize will be provided.

CONTEST DRAW

Three random draws will be conducted at Sponsor’s office on December 21, 2009, January 18, 2010 and February 22, 2010 at 3 p.m. EST from all eligible entries received during the contest period.

HOW TO WIN

In order to be declared a winner, selected contest entrants must comply with the following conditions:

1. Be reached by phone or e-mail within ten (10) days of the random draw.
2. The selected participant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a pre-arranged, mutually convenient time.
3. Duly complete and sign the Receipt, Release, Discharge, Publicity and Indemnity form that will be sent to him/her by mail, fax or email and return it to the contest organizers within fifteen (15) days following its receipt.

Sponsor must receive the executed Receipt, Release, Discharge, Publicity and Indemnity form from the potential prize winners or the potential winner will be disqualified and will not receive the prize.

GENERAL RULES

By entering this contest, entrants accept and agree to be bound by the Official Contest Rules and Regulations and the decisions of Yak Communications (Canada) Corp. (“the Sponsor”) and independent judging organization, if any, which are final, binding and conclusive on all matters relating to this contest. All entries become the property of the Sponsor and no correspondence will be entered into except with selected entrants who will be notified by telephone or email. The Sponsor reserves the right to disqualify all entrants who fail to follow these Official Contest Rules and Regulations or who make any misrepresentation relating to the contest, drawing and redemption of the Prize. This contest is subject to all applicable federal, provincial and municipal legislation. Entry constitutes permission to use the winner’s name, photograph and/or voice recording for publicity purposes without additional compensation or permission, except where prohibited by law.

The Sponsor is committed to respecting your privacy rights. Any personal information collected will be handled in strict accordance all applicable privacy legislation. The Sponsor will not sell your personal information collected for this contest to any third parties.

By entering this contest, you hereby consent to the Sponsor’s collection, use and disclosure of your personal information in order to manage and administer this contest. By leaving checked, the relevant box on the entry form, you also consent to the disclosure of your personal information to members of Yak marketing so that they may tell you directly, including by telemarketing, about their products and services.

The Sponsor shall not be responsible for any failure of the website during the promotion or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, at its sole discretion to cancel or suspend this contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the Prize awarded in this contest or the events forming part of this contest.

Decisions of the Sponsor are final and binding with respect to all aspects of this contest.

The Sponsor reserves the right to withdraw or terminate this contest at any time without prior notice.
