FIRST MONTH FREE SERVICE OFFER

The First Month Free offer is open to all Yak customers who are Canadian residents and who have reached the age of majority. Employees, members of their immediate families and persons domiciled with employees of Globalive Communications Corp. and Yak Communications (Canada) Corp., their advertising and promotional agencies are not eligible. By redeeming the voucher customers agree to abide by the terms and conditions noted below and the decisions of Yak Communications (Canada) Corp., (the “Sponsor”) which are final.

OFFER PERIOD

Offer runs from September 18, 2009 to December 31, 2009.

OFFER TERMS AND CONDTIONS

Value is based on sign up month for promotion and cannot be upgraded post sign-up. Credit in amount of service purchased will be applied to month one billing. Each month thereafter service will be billed at regular rate of service. For Yak High Speed Internet sign ups, cost of modem is not included. One promotional offer per account. Offer not applicable to any other service on customer account and is non-transferrable and has no cash value.

ELIGIBILITY

To be eligible customer account may not have a 30+ balance. Customer must have made at least 3 payments. Customer is on PAP. Offer open to new and existing customers. Customers must be (1) current customers with Yak Communications (Canada) Corp., adding Yak Home Phone Fully Loaded, Yak High Speed Internet or Yak Basic, Yak Lite or Yak Fully Loaded Paks or (2) new customers signing up for Yak Home Phone Fully Loaded, Yak High Speed or Yak Basic, Yak Lite or Yak Fully Loaded Paks (3) new or existing customers signing up for Unlimited Long distance (Canada and USA or International) provided they sign up with a credit card on pre-authorized payment.

THE OFFER

Offer is based on value of service signed up for at time of promotional offer and cannot be upgraded with change in customer portfolio. Costs of any additional services will be billed to customer for the term of free service.

THE FOLLOWING CONDITIONS APPLY:

The offer must be accepted as awarded without substitution and is not transferable or redeemable for cash or allowed to be sold. The Sponsor reserves the right to substitute the prize in whole or in part in the event that all or any of the components of the offer is unavailable. In the event that the recipient is unable to redeem the offer due to reasons beyond the control of the Sponsor, their employees, representatives, agents and all parties associated with this offer, no compensation or substitution offer will be provided.

GENERAL RULES

By accepting the recipients accept and agree to be bound by the terms and conditions noted above and the decisions of Yak Communications (Canada) Corp. (“the Sponsor”) and independent judging organization, if any, which are final, binding and conclusive on all matters relating to this offer. This offer is subject to all applicable federal, provincial and municipal legislation.

The Sponsor is committed to respecting your privacy rights. Any personal information collected will be handled in strict accordance all applicable privacy legislation. The Sponsor will not sell your personal information collected to any third parties.

The Sponsor shall not be responsible for any failure of the website during the offer or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, at its sole discretion to cancel or suspend this offer should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Offer. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Sponsor shall not be responsible in any way for the use of, or bear any liability whatsoever in any way attributable to, the offer awarded or the events forming part of this offer.

Decisions of the Sponsor are final and binding with respect to all aspects of this offer.

The Sponsor reserves the right to withdraw or terminate this offer at any time without prior notice.
